5.4 Price Changes:

• Current subscribers grandfathered for one billing cycle
• You may cancel if you disagree with new pricing

5.5 Refund Policy:

• 14-day money-back guarantee for new annual subscriptions
• Monthly subscriptions: no refunds for partial months

7.2 No Guarantee of Results:

• AI-generated content may require editing
• Historical performance does not predict future results

7.3 Service Availability:

• We strive for 99.9% uptime but do not guarantee it
• Scheduled maintenance will be announced in advance
• We are not liable for outages beyond our control
• Third-party platform issues may affect Service functionality

7.4 Limitation of Liability:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREMEDYX SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Lost profits, revenue, data, or business opportunities
• Damages exceeding fees paid in the past 12 months
• Issues caused by your misuse of the Service
• Third-party platform policy violations

7.5 Exceptions:
These limitations do not apply to:

• Liability that cannot be excluded by law
• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Breach of implied terms that cannot be excluded

7.6 Essential Purpose:

• After 30 days, data will be permanently deleted

9.4 Data Export:

• You may request data export before termination
• We provide data in standard formats (CSV, JSON)
• Export requests processed within 7 business days

9.5 Outstanding Charges:

• You remain liable for charges incurred before termination
• No refunds for unused portions of subscriptions
• Legal collection may be pursued for unpaid amounts

9.6 Survival:
Sections that by their nature should survive termination will remain in effect, including:

• Intellectual property rights
• Limitation of liability
• Indemnification
• Governing law

These terms are governed by the laws of Israel. Any disputes will be resolved in Israeli courts.

12. Artificial Intelligence Usage

12.1 AI Services:
The App includes AI-powered features including:

• Data analysis and predictions
• Campaign optimization suggestions
• Automated responses and conversations
• Image and text analysis

12.2 AI Limitations:
AI-generated content:

• May not be 100% accurate
• Requires human review before use
• Does not constitute legal, financial, or medical advice
• May contain outdated information
• Is not guaranteed to be free from bias

12.3 Your Responsibility:

• You are responsible for reviewing generated content
• Verify facts before publishing
• You are liable for any content you publish
• Ensure compliance with copyright laws

12.4 Prohibited AI Uses:
You may NOT use AI tools to:

• Create harmful, offensive, or illegal content
• Impersonate others
• Spread misinformation
• Harass or bully

• You are responsible for any violations
• Your accounts may be suspended independently

13.4 Reporting Violations:

• Any user can report violating content
• Reports reviewed within 48 hours
• We reserve the right to remove violating content
• Repeat violations may result in account closure

14. Indemnification

14.1 Your Indemnification Obligation:
You agree to indemnify and hold harmless Cremedyx, its directors, and employees from any:

• Damages or losses
• Costs and expenses (including legal fees)

• With pro-rated refund of prepaid amounts

16. General Provisions

These Terms constitute the entire agreement between you and Cremedyx, superseding any prior oral or written agreements.

16.2 Severability:
If any provision is found invalid:

• The remaining Terms remain in effect
• The invalid provision is replaced with the nearest valid provision

16.3 No Waiver:

• Failure to enforce any right is not a waiver
• Waiver must be in writing and explicit
• Waiver once does not mean future waiver

16.4 Assignment:

• You may not assign your rights without our written consent
• We may assign our rights to any successor
• Upon merger or acquisition, Terms transfer automatically

16.5 Relationship Between Parties:

• This agreement does not create a partnership or agency
• You are an independent contractor, not an employee
• Neither party may bind the other
